Investors Living Trust
Probate solved, nothing else touched. Some clients want the probate problem solved and nothing else: no sub-funds, no discretionary layer, no tax structuring. This is the plainest way we can do that.
What an Investors Living Trust does
It is built for rental and investment property, and one trust can hold as many properties as you like. It can hold your home as well.
Without it, every property in your estate waits on the grant of probate. Where there are several, that wait runs on while rent still has to be collected and bills still have to be paid.
What changes is who holds the legal title, so a property does not have to wait for a grant before it can be sold, transferred or managed.
The point of it is speed. Your family can sell, transfer or manage a property straight away, instead of waiting on a grant before anything can happen.
What it changes about your tax
Nothing at all. Not your Income Tax — rent is received and taxed exactly as it is now. Not your Capital Gains Tax. Not your Inheritance Tax.
And no Stamp Duty Land Tax on the transfer, or Land Transaction Tax in Wales: only the equity is transferred, so nothing is given in exchange.
It is a bare trust, which means it is transparent for tax. Whatever is inside it is still treated as yours and taxed as yours, exactly as before, for better or for worse.
What it does not do
Because it is a bare trust, nothing has been given away and the value stays in your estate. It does not save Inheritance Tax, and it is not protection against care fees. It gives no protection against sideways disinheritance on its own either — clients who want that almost always have a Protective Will Trust in their Will, which does. If you want a discretionary layer, that is a Family Asset Protection Trust; if you want the family home treated separately, an Estate Allocation Trust.

An Investors Living Trust is £3,495 at Standard and £4,695 at Premium for one person, and £4,495 and £5,995 for a couple. Every price is a total and includes the £1,000 legal drafting disbursement.
